Policy Delivery and Setup

It is the responsibility of the hirer to ensure the venue is ready for the installation of the equipment at the agreed time. Should Wishful Events be delayed due to the venue not being ready an accessible charge may be incurred. Wishful Events aim to have everything set-up within 1- 2hours depending on access to the venue and any bespoke aspects of the hire packages. It is the responsibility of the hirer to ensure ease of access to the venue for unloading and loading of equipment. Any parking fees or fines Wishful Events incur whilst setting up must be paid by the hirer. If the venue is in a residents parking zone it is the hirer's responsibility to provide Wishful Events with a visitors parking permit on arrival at the venue. Any restrictions must be reported to Wishful Events prior to the event. The hirer will forfeit the full cost of the hire if on the day restricted access prevents, Wishful Events setting up and the hire proceeding. The hire packages include standard set-up and additional charges will be made for delivery. Wishful Events will endeavour to arrive at the location and set up as scheduled, however from time to time delays can occur that are beyond Wishful Events control or responsibility. Wishful Events will of course contact the hirer as soon as possible to make aware of the delays and expected ETA.

Safety

Wishful Events do not accept liability for any accidents, injury or damage that may occur whilst the equipment is on hire. The equipment must be supervised at all times by a responsible person over the age of 18 (preferably the hirer). It is the hirer's responsibility to ensure access to two 13 Amp sockets is provided to the screening location. Wishful Events are happy to provide extension cables and advise on ways to safely provide power to the screening source but will not take responsibility for any problems that arise or accidents that are caused by cables infringing neighbour’s property, obstructing public footpaths or crossing public roads. No food or drinks to be allowed on or near the Wishful Events equipment. No smoking or barbecues allowed near the Wishful Events equipment. Wishful Events have a duty to observe safe working practices at all times. Should Wishful Events observe or deem something unsafe they have the right to request changes or refuse to allow the hire to proceed. Health and Safety is the sole responsibility of the hirer whilst using the equipment supplied by Wishful Events.

Equipment on Hire

Wishful Events will supply all equipment in a safe and usable condition. If the hirer is not satisfied with any aspect of the equipment, they must state at the time of set up before signing the Delivery & Set-Up Acceptance Form. Equipment will be deemed to be in good working order, except for any defects not detectable by reasonable examination. The equipment is visually checked and tested at the hire location once the hire session as finished. Any damage (other than fair wear and tear) will be recorded and reported at the time of the time then repaired by Wishful Events and will be charged to the hirer. If any of the equipment is lost or stolen during the hire period, or extensions thereof, Wishful Events reserves the right to charge the hirer the retail price of the lost or stolen item/s and potentially any loss of hire’s that cannot proceed due to the loss of equipment. Wishful Events will provide printed instructions to the hirer on how to use the equipment.  If any equipment should fail while on hire the hirer should advise Wishful Events by telephone as soon as possible. The hirer should not attempt to repair any equipment without Wishful Events permission. If any equipment fails whilst on hire Wishful Events will offer you a refund on the equipment hired. Wishful Events reserve the right to impose additional charges at the end of the hire period if the equipment on hire is not available to collect at the agreed collection time. Hire periods are as follows; Daytime Hire 9am- 4pm, Evening Hire 6pm- Collection following morning Daytime and Evening Hire 9am on the day agreed- collection to be following morning. Full weekend hire Saturday 9am- Sunday 4pm. Morning collection times to be agreed with hirer when booking.      

Disclaimer

Please note that all persons using this Wishful Events equipment do so at their own risk. The person/organisation hiring the equipment will be responsible/liable for any damage or injury occurring from use or misuse of the equipment. These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are adhered to. It is the hirer's responsibility to ensure that the venue they are showing a film has the appropriate premises license and that if required they have obtained the correct screening license. Wishful Events take no responsibility for the content that are shown on their equipment, arrange or provide any licenses nor provide any content (movies, box-sets, games) and any copyright infringement that may occur and subsequent offences and legal action are solely the responsibility of the hirer. Wishful Events welcome any discussion prior to any booking be agreed regarding any and all terms stated and expressed within this document.  

Cancellation & Alteration Policy

Wishful Events like all small businesses can be significantly affected by late cancellations, matters which are beyond our control or issues created by a customer or other 3rd party, therefore reserve the right to charge cancellation fees in certain circumstances. That being said, we value the meaning of great customer service and will always apply a pragmatic approach when faced with such situations with the goal of amicable resolution.

Deposits

If the hirer requests to cancel a confirmed booking less than 14 days prior to the event, the hirer will forfeit 100% of the deposit. If the hirer requests to cancel a confirmed booking between 14 - 21 days prior to the event, the hirer will receive 50% of their deposit. If the hirer requests to cancel a confirmed booking more than 21 days prior to the event, the hirer will receive 100% of their deposit. If the hirer requests an alteration to the original booking date, this should be done no later than 14 days prior to the event. All alteration requests are subject to availability and permissible for a £20 administration fee. If there is no availability of the dates proposed, cancellation terms would apply as above.

Weather

Wishful Events are unable to guarantee the weather. If you have booked an outdoor screening and heavy or persistent rain and/or strong winds are forecast we will contact you on the morning of the booked date to discuss what options are possible such as an alternative indoor venue or postpone to another available date. Once the garden cinema is setup but light showers are forecast, Wishful Events will make an assessment and if satisfied safe to proceed will agree for the use of the cinema to go ahead as long as the hirer follows our instructions for keeping the garden cinema equipment dry. This is for safety of all as well as protecting our equipment! However, should the weather worsen we would expect the hirer contact Wishful Events without delay and switch off the equipment as soon as possible, disconnect it from the mains power supply and ensure any electrical equipment (projector, sound system etc.) is safely and without any risk to persons moved clearly under cover such as the gazebo. In such circumstances it would be considered unsafe or permissible for the hire to continue and regrettably Wishful Events will not offer a refund.

Site Suitability

When Wishful Events will always discuss the location for the setup with the hirer prior to any booking confirmation as there are specifics which apply in order for the equipment to operate safely and optimally. Level dry ground, access to two 13amp sockets (either indoor or garden sockets), area for the bell tent and screen are free of lateral and overhead obstacles (tree branches, sharp bushes, overhead cables, washing lines etc.) A booking will only be taken if the hirer assures our criteria can be met. It is the responsibility of the hirer to ensure the venue is ready for the installation of the equipment at the agreed time. Should Wishful Events be delayed due to the venue not being ready or accessible charge may be incurred. Should when Wishful Events arrive at site and discover that the site does not meet our operating criteria, we will inform the hirer that we cannot proceed with the booking unless immediate changes can be made to the site to enable the equipment to be setup. If within 30 minutes this is not possible or achieved the booking will be void and 100% of the hire forfeited by the hirer.

Site Access

If the venue is in a residents parking zone it is the hirer's responsibility to provide, Wishful Events with a visitors parking permit on arrival at the venue. The hirer will forfeit the 100% of the hire if on the day restricted access prevents, Wishful Events setting up and the hire proceeding.

Force Majeure

Wishful Events cannot accept responsibility or pay any compensation where the performance or prompt performance of the booking is prevented or affected by reason of circumstances which amount to “force majeure”. Circumstances amounting to “force majeure” include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the location set for the booking (which cannot reasonably be remedied to a satisfactory standard before the start of your stay) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic and all similar situations beyond our control. It is explicitly agreed that an event of force majeure suspends execution of the reciprocal obligations for Wishful Events and the hirer, and that each party shall pay expenses resulting therefrom.
